A Metropolitan Magistrate may release an accused on bail in non-bailable offence except in following case(s) if

There are reasonable grounds for believing that he has been guilty of an offence punishable with death or imprisonment for life

There are reasonable grounds for believing that he has been guilty of a cognizable offence and he has been previously convicted of an offence punishable with imprisonment for seven years

He had been previously convicted on two or more occasions of a cognizable offence punishable with imprisonment for three years
